These Terms & Conditions (the “Terms”) govern your access to and use of the Kinesin Patient Portal (the “Portal”), an online service that lets patients of participating practices manage their care — including registration, appointments, secure messages, prescriptions, medical records and billing. By creating an account or using the Portal you agree to these Terms.
1. About us
The Portal is operated by Kinesin Health (“Kinesin”, “we”, “us”). If you have any questions about these Terms, contact us using the details in section 13.
2. Eligibility and registration
You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. You agree to provide accurate, current and complete information during registration and to keep it up to date.
Registration is completed in steps: you provide your email and set a password, verify your email address with a one-time code, and provide your personal and contact details. After you submit your registration your account is created in a pending state and must be approved before you can access patient features. We may refuse, suspend or revoke registration at our discretion.
3. Your account and security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. If you sign in using a third-party provider (such as Microsoft or Google), you are also bound by that provider’s terms. Notify us immediately if you suspect any unauthorised use of your account.
4. Acceptable use
When using the Portal you agree not to:
- use the Portal for any unlawful, fraudulent or harmful purpose;
- access or attempt to access another person’s account or data without authorisation;
- upload malicious code or interfere with the security or operation of the Portal;
- copy, scrape or reverse-engineer any part of the Portal except as permitted by law.
5. Medical disclaimer
The Portal is a tool to help you manage administrative aspects of your care. It does not provide medical advice, diagnosis or treatment, and it is not a substitute for professional clinical judgement.
The Portal is not intended for emergencies. If you are experiencing a medical emergency, call 112 or 999, or attend your nearest emergency department immediately. Do not use secure messages to report urgent or emergency symptoms.
6. Services facilitated through the Portal
The Portal may allow you to request or manage appointments, exchange secure messages with your practice, view prescriptions and medical records, and view or pay for services. These features are provided by, and remain the responsibility of, your practice and its clinicians. Availability of specific features may vary by practice.
7. Data protection
We process your personal data — including health information — in accordance with our Privacy Policy, which forms part of these Terms. Please read it to understand how we collect, use and protect your data.
8. Intellectual property
The Portal, including its software, design, text and graphics, is owned by or licensed to Kinesin and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Portal for your own personal, non-commercial use of your care.
9. Availability, changes and termination
We aim to keep the Portal available but do not guarantee uninterrupted access, and we may modify, suspend or discontinue features at any time. We may suspend or terminate your account if you breach these Terms or where required for security, legal or clinical reasons. You may stop using the Portal at any time.
10. Limitation of liability
To the fullest extent permitted by law, Kinesin is not liable for indirect or consequential loss, or for loss arising from your reliance on the Portal for clinical decisions. Nothing in these Terms limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence.
11. Governing law
These Terms are governed by the laws of Ireland, and the courts of Ireland have exclusive jurisdiction over any dispute arising from them.
12. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the “Last updated” date above and, where appropriate, notify you. Your continued use of the Portal after changes take effect constitutes acceptance of the updated Terms.
